By booking an activity, tour, or rental equipment with Explore Niagara NY, LLC, the person making the reservation (“Participant”) assumes responsibility for all individuals included in the booking.

Fitness and Acknowledgment of Terms: I certify that all members of my group are physically able to participate in the selected activity or rental equipment we have booked.

Use of This Waiver: I understand that this Accident, Waiver, and Release of Liability will be used by Explore Niagara NY, LLC, its owners, employees, independent guides, contractors, 3^rd party booking services, and any associated organizers of the activity in which I and my group participate.

Release of Liability: I hereby waive, release, and discharge Explore Niagara NY, LLC, its employees, independent guides, contractors, and representatives from any and all liability, including but not limited to liability arising from negligence, for any death, disability, personal injury, property damage, theft, or other loss that may occur to me or members of my group, including travel to and from the activity location.

Indemnification and Agreement Not to Sue: I agree to indemnify, hold harmless, and not bring legal action against Explore Niagara NY, LLC, its employees, independent guides, and representatives for any claims or liabilities arising from participation in the activity or use of equipment, whether caused by negligence or otherwise.

Assumption of Risk: I acknowledge that hiking, e‑bike riding, kayaking and related outdoor activities involve inherent risks, including but not limited to; uneven terrain, water hazards, weather conditions, temperature, equipment failure, vehicular traffic, wildlife, dehydration, and the actions of other participants or individuals.
I understand that these activities may test physical limits and carry the potential for injury or death.

Medical Treatment: In the event of accident, injury, or illness, I consent to receive medical treatment deemed advisable and understand that I am responsible for all associated medical and rescue costs, including services provided by local, state, or federal agencies.

Photography and Media Release: I understand that participants may be photographed or recorded during the activity and grant Explore Niagara NY, LLC permission to use such images for promotional purposes.

Legal Scope: This waiver and release shall be interpreted broadly to provide a release to the maximum extent permitted under applicable law.

Certification: By signing, I acknowledge that I have read and fully understand this document. I am aware that it is a release of liability and a contract, and I signed it voluntarily. I acknowledge that I am signing this waiver on behalf of all participants in my group and represent that I have authority to do so.
