When booking with us, you agree to all Policies, Terms, and Conditions.

Payment:  All tours and rentals must be prepaid in advance. All dates are sold on a first-come, first-served basis.  
Cancellation Policy: Because tour guides are booked well in advance, refunds are as follows:
– 75% Refund if canceled at least 14 days before the activity date.
– 50% refund within 14 days of activity start time.
– No refund or credits for cancellation within 24 hours of the activity.
– No refunds for no-shows.
– If Explore Niagara NY cancels at any time due to weather, conflicts, or any other reasons, a 100% refund will be given.
Dress, Footwear & Gear Dress appropriately for weather conditions and wear hiking footwear: boots, hiking footwear or sneakers are required. No open-toed shoes, sandals, flip flops, Crocs, etc. Trails may have puddles and muddy areas. The guide has the right to refuse participation if a hiker does not have the appropriate footwear for the hike. Dress for the weather conditions. The guide does not provide rainwear, hats, gloves, sunscreen, water, etc. Bring a backback to carry your belongings. 
Guide Provides:
Your guide will carry a first aid kit and other safety items required by NY State Guide requirements.
Food & Drink: The guide does not provide water, drinks, snacks, etc. for hikers. You can add drinks when booking your tours. Plan accordingly.
Hiking Guide Instructions: All hikers must adhere to the rules and commands of the guide. This includes not wandering off trails, entering the water, infringing on nature, loud or foul language, disrespecting or disturbing other hikers’ experience. Hikers must be prepared to pack out any garbage per Leave No Trace policies. There are no trash cans along the Niagara River gorge trails. 
Weather: The tour guide makes the final determination if the tour can safely continue as planned based on weather conditions. Hikes will take place in drizzle, light rain, cold or windy conditions. It is best to be prepared for all hiking conditions. Refunds will not be given for hikers deciding not to participate.
Alternate Routes: Safe access to hiking trails can change quickly due to rockslides, weather, dangerous trail conditions, etc. The guide can make changes to the hike without recourse from the customer.
Liability: Explore Niagara NY and Niagara Concessions is not responsible for any injuries. Any economic or non-economic loss in relation to your experience is limited to the total fees actually paid. Customers are required to sign a liability waiver prior to participation.  
Rescue: Individuals who require medical assistance, rescue or other park services are responsible to pay for all associated fees.
Pets: Dogs are allowed on hikes – $10 fee per dog. One dog per adult hiker. Dogs must follow our strick policy for the safety and enjoyment of all hikers. Dogs must adhere to NY State Parks dog policies, including: all dogs must be on a leash no longer than 6’ in lengt and be up to date on their rabies vaccinations. Our tours do not allow dogs under 20lbs or over 100lbs. Aggressive known breeds (Pitbull, Rottweiler, Chow, etc. and related mixed breeds) must be muzzled during hikes. Dog owners are liable for any injuries or damage caused by their pets. Hikers who cannot control their pet(s) or if their pet is creating a nuisance for other hikers, will be required to distance themselves at least 100 feet from the group and guide. The guide will make the final determination. There are no hiking refunds for pet owners that must be removed from the group hike due to dog related issues. Pet owners must be prepared and responsible for clean up and pack out of pet waste based on Leave No Trace policies. 

Kayak Rental Policies

All kayak rentals require a credit card security deposit of $200 per kayak for damaged equipment. Lost or stolen equipment will be charged the full retail replacement price of the lost item. Credit Card security deposits will be returned within 24 hours.
Kayak Cancellations: Refunds are as follows:
– 75% Refund if canceled at least 14 days in advance.
– 50% refund within 14 days of the rental.
– No refund or credits for cancellation within 24 hours of the rental.
– If Niagara Concessions cancels due to weather, conflicts, or any other reason, a 100% refund will be given.
– All rentals require a signed liability waiver prior to taking position of rental equipment.
